Terms of Service

1. Acceptance of Terms

By accessing or using Candyfloss ("the Service"), operated at candy-floss.ai, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Candyfloss is a talent intelligence platform that provides access to professional profile data for recruitment purposes. The Service includes search functionality, profile viewing, saved searches, data exports, and related features.

3. Account Registration

You must create an account to use the Service. You agree to provide accurate information and keep your account credentials secure. You are responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these terms or that we reasonably believe are being used fraudulently.

4. Subscription Plans and Payment

Candyfloss offers the following subscription tiers:

• Free - 5 lifetime searches and 5 credits
• Pro ($99/month) - 250 searches/month, 100 credits/month, all features
• Team ($299/month) - 1,000 searches/month, 500 credits/month, up to 5 seats
• Concierge ($500/role) - one-time service, we source candidates for you

Payments are processed by Stripe. Subscriptions renew automatically unless cancelled before the next billing date. Annual billing is available at a discounted rate.

Refund policy: Refunds are available only if you have not used any searches or credits during the current billing period. Once any searches or credits have been consumed, no refund will be issued for that billing cycle. To request a refund, contact us within 14 days of the charge.

4a. Credits and Usage

Credits are consumed when you use certain features, including:

• Revealing a candidate's email address
• Generating AI-powered outreach emails
• Enriching profiles with GitHub data
• Finding similar candidates

Free plan credits are lifetime limits. Pro and Team credits reset monthly. Unused credits do not roll over to the next billing period.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Scrape, crawl, or use automated tools to extract data in bulk from the Service
• Resell, redistribute, or sublicense access to the data or Service
• Use the data to discriminate against individuals based on protected characteristics
• Harass, stalk, or send unsolicited messages to individuals found through the Service
• Attempt to reverse-engineer, decompile, or access the source code of the Service
• Circumvent usage limits, authentication, or access controls

6. Data Sharing and Privacy

What data we collect: We collect your account information (name, email), usage data (searches, feature usage), and payment information (processed securely by Stripe, we do not store card numbers).

Who has access: Your data is accessible only to Candyfloss and our essential service providers:

• Clerk - authentication and account management
• Stripe - payment processing
• Anthropic - AI features (search interpretation, outreach generation). Query text is sent to generate results but is not stored or used for training.
• Upstash - usage tracking and caching
• Sentry - error monitoring (anonymized)

Why we share data: Data is shared strictly to provide and improve the Service. We do not sell your personal data to third parties, use it for advertising, or share it beyond what is necessary to operate the platform.

Your rights: You may request deletion of your account and all associated data at any time. See our Privacy Policy for full details on data handling, retention, and your rights.

7. Data Accuracy

Professional profile data is sourced from publicly available information and licensed data providers. While we strive for accuracy, we do not guarantee that all data is complete, current, or error-free. Salary estimates are statistical approximations based on market data and should not be relied upon as exact figures.

You acknowledge that data may contain inaccuracies and agree to verify information independently before making hiring or business decisions.

8. Intellectual Property

The Service, including its design, code, features, and branding, is owned by Candyfloss and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

Professional profile data accessed through the Service is licensed for recruitment and talent intelligence purposes only. You may not build competing databases or products using data obtained from the Service.

9. Limitation of Liability

To the maximum extent permitted by law, Candyfloss shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claim arising from these terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Candyfloss from any claims, losses, or damages (including legal fees) arising from your use of the Service, your violation of these terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (such as limitation of liability and indemnification) will remain in effect.

12. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes by posting an update on this page. Continued use of the Service after changes constitutes acceptance of the revised terms.

13. Governing Law

These terms are governed by and construed in accordance with applicable law. Any disputes arising from these terms or the Service shall be resolved through good-faith negotiation, and if necessary, binding arbitration.
